Welcome to JustSeva, your trusted platform for on-demand services. These Terms & Conditions (“Terms”) form a legal agreement between you (“User/Customer/Partner”) and JustSeva regarding your use of our website, mobile app, and services.
By accessing or using JustSeva, you:
- Agree to be bound by these Terms and our policies (including Privacy & Refund Policy).
- Confirm that the information you provide is accurate and lawful.
- Accept that JustSeva acts as a facilitator, connecting Customers with verified Partners, and is not the direct service provider.
⚠️ If you do not agree with these Terms, please stop using our services immediately.
These Terms are designed to ensure safe, transparent, and fair use of the Platform for both Customers and Partners. Please read carefully to understand your rights, responsibilities, and limitations.
1. Definitions
For the purpose of these Terms & Conditions, the following terms shall have the meanings assigned to them:
- “Platform”: Refers to the JustSeva ecosystem, including the official website (justseva.com), mobile applications (iOS/Android), partner dashboards, customer portals, and all related digital services, tools, and communication channels operated by JustSeva.
- “Customer” or “User”: Any individual or entity accessing the Platform to browse, request, or avail services listed on JustSeva. This includes both registered and guest users.
- “Partner” or “Service Provider”: Any individual professional, business, or vendor registered with JustSeva to offer services through the Platform, whether as an independent contractor, freelancer, or business entity.
- “Order” or “Booking”: A confirmed service request placed by a Customer through the Platform, which may include details such as service category, sub-category, schedule, location, and payment terms.
- “We,” “Us,” or “Our”: Refers to JustSeva, its parent company, affiliates, directors, officers, employees, representatives, and authorized agents.
2. Eligibility
- Age Requirement: You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to create an account and use the services on JustSeva.
- Accurate Information: By registering, you confirm that all details provided (such as name, contact number, email, address, and payment information) are true, accurate, current, and complete at the time of registration and throughout your use of the Platform.
- Organizational Use: If you are registering or using the Platform on behalf of a company, partnership, or organization, you represent and warrant that you are duly authorized to bind that entity to these Terms.
- Account Responsibility: Each user may only create one account unless explicitly permitted by JustSeva. Sharing or transferring accounts to another person or entity without prior approval is strictly prohibited.
- Right to Refuse: JustSeva reserves the right to deny, suspend, or terminate access to any user who does not meet the eligibility requirements or who provides false/misleading information.
3. Scope of Services
- Facilitation Role: JustSeva is an online aggregator and facilitator that connects Customers seeking services with Partners who are qualified to provide them.
- Service Categories: The Platform enables Customers to request services across a variety of categories, including but not limited to:
- Home Services (cleaning, repairs, maintenance, etc.)
- Personal Care & Grooming (salon, spa, wellness, etc.)
- Repairs & Maintenance (electrical, plumbing, appliance repair, etc.)
- Events & Weddings (planning, decoration, catering, etc.)
- Education & Training (tuition, coaching, skill development, etc.)
- Health & Wellness (basic wellness, fitness, preventive care, etc.)
- Disclaimer of Direct Responsibility: JustSeva does not directly provide these services. The responsibility for the quality, safety, legality, and execution of services lies entirely with the respective Partner/Service Provider.
- Our Limited Role Includes:
- Displaying Listings – Presenting service categories, partner details, prices, and availability.
- Booking & Scheduling – Enabling Customers to request, confirm, and manage service orders.
- Payment Processing – Facilitating secure payment collection and settlements between Customers and Partners.
- Communication Tools – Offering a channel for Customers and Partners to connect, coordinate, and resolve queries.
- Exclusion of Liability: Any dispute, delay, cancellation, damage, or dissatisfaction arising from the actual service is between the Customer and the Partner. JustSeva may assist in dispute resolution but is not liable for the final outcome of services.
4. User Accounts
- Account Creation:
Customers and Partners must create an account on the Platform using a valid mobile number, email address, and/or other required details. Additional verification (such as OTP or ID proof) may be required to activate or continue using certain features. - Accuracy of Information:
You agree to provide true, current, and complete information during registration and to update it promptly if there are any changes. Providing false or misleading details may result in account suspension or termination. - Security & Confidentiality:
- You are solely responsible for maintaining the confidentiality of your login credentials (username, password, OTP, etc.).
- Any activity performed through your account will be deemed to have been carried out by you.
- If you suspect unauthorized access, you must notify JustSeva immediately at support@justseva.com.
- Prohibited Use:
You may not share, sell, transfer, or assign your account to another person or entity without written permission from JustSeva. - Suspension & Termination:
JustSeva reserves the right to suspend, restrict, or terminate your account without prior notice if you are found to be engaged in:- Fraudulent activity or misuse of services.
- Violation of these Terms or applicable laws.
- Abusive, harmful, or unethical behavior towards Customers, Partners, or JustSeva staff.
- Multiple Accounts:
Unless explicitly permitted, you may not maintain more than one active Customer account and one Partner account on the Platform.
5. Booking & Order Process
- Placing an Order
- Customers may book services through the Platform by selecting the desired category, sub-category, time slot, and location.
- Once the booking is submitted, the Customer will receive a confirmation via SMS, email, and/or app notification.
- The booking will remain in a “Service Request” status until accepted by a Partner.
- Acceptance of Order
- Partners have the right to accept or decline an order request based on availability, expertise, or service feasibility.
- Once a Partner accepts the order, it becomes a binding commitment for both the Partner and the Customer.
- Customers will be notified of the acceptance, along with Partner details (such as name, contact, and estimated arrival time).
- Rescheduling
- Customers may request rescheduling within the permitted window displayed on the Platform.
- Partners may also suggest rescheduling in unavoidable circumstances, subject to Customer approval.
- Completion of Service
- Partners are required to:
- Perform services in a timely, professional, and safe manner.
- Use appropriate tools, materials, and expertise for the booked service.
- Customers are required to:
- Ensure access to the premises at the scheduled time.
- Provide necessary cooperation (e.g., accurate instructions, safe environment, and availability during the service).
- Services will be marked as “Completed” on the Platform once the Partner confirms, and the Customer acknowledges.
- No-Show & Delays
- If a Customer is unavailable at the scheduled time, the order may be marked as Customer No-Show, and charges may apply.
- If a Partner fails to attend or significantly delays service without valid reason, the Customer may be eligible for a refund or rescheduling, as per JustSeva’s policies.
6. Payments & Wallet
- Payment Methods
Customers may pay for services using UPI, Credit/Debit Cards, Net Banking, Mobile Wallets, or Cash (if cash-on-delivery is enabled in their region). All digital payments are processed through secure, RBI-compliant payment gateways. - Payment Collection
- Customers agree to pay the full amount displayed at the time of booking, inclusive of applicable taxes, platform fees, and charges.
- In the case of online payment, the amount is collected by JustSeva and settled with the Partner after deducting applicable platform charges/commission.
- In the case of cash payment, the Partner is responsible for collecting the amount directly from the Customer.
- Partner Settlements
- Payments due to Partners (post-deductions) will be credited to their JustSeva Wallet or designated bank account, as per the withdrawal policy.
- Settlement timelines may vary but will typically occur within the agreed business cycle (e.g., weekly or monthly).
- JustSeva Wallet
- The Wallet is a virtual account provided to Partners to track credits, debits, and commission deductions.
- Withdrawals are allowed only if:
- The Partner meets the minimum balance threshold.
- The minimum holding period (e.g., 3–7 days) has elapsed to account for cancellations/refunds.
- Wallet balances are non-transferable and may only be withdrawn to the verified Partner bank account.
- Refunds
- Refunds to Customers (if applicable under cancellation or dispute resolution) will be processed to the original payment method or credited to the Customer’s Wallet within 7–10 business days.
- Fraudulent or Invalid Transactions
- Any suspected fraudulent, unauthorized, or invalid transactions will lead to suspension of the concerned account.
- JustSeva reserves the right to withhold payments, reverse Wallet credits, and initiate legal action in such cases.
- Platform Rights
JustSeva may revise commission rates, service fees, or settlement timelines at any time with prior notice to Partners.
7. Pricing, Taxes & Invoices
- Transparency of Pricing
- All service charges are clearly displayed on the Platform before a booking is confirmed.
- Prices may vary depending on service category, location, time of booking, demand, and availability of Partners.
- Any promotional offers, discounts, or coupon codes will be applied at checkout, subject to their respective terms and conditions.
- Additional Charges
The final billing amount payable by the Customer may include:- GST/Applicable Taxes as mandated by Government regulations.
- Platform/Convenience Fees charged by JustSeva for facilitating the service.
- Out-of-Scope or Extra Work Charges (if the Partner performs services beyond the initially booked scope, with Customer’s consent).
- Invoices & Receipts
- Upon completion of service, Customers will receive a digital invoice/receipt via email and/or the JustSeva app.
- The invoice will clearly show a breakdown of:
- Service charges
- Taxes (GST, if applicable)
- Platform fees
- Discounts or credits applied
- Partners will have access to their earnings statement via the Partner dashboard or Wallet section.
- Price Revisions
- JustSeva reserves the right to update or revise prices, taxes, and fees at any time.
- Such changes will apply prospectively and will not affect confirmed bookings.
- Errors & Discrepancies
- In case of any inadvertent pricing error or system glitch, JustSeva reserves the right to cancel the booking or adjust the invoice after informing the Customer.
8. Cancellation & Refund Policy
- Customer Cancellations
- Customers may cancel a booking within the permitted time window displayed at the time of placing the order.
- If the cancellation is made before the Partner accepts, the Customer will be eligible for a full refund (if payment was already made).
- If the cancellation is made after Partner acceptance but before service commencement, a cancellation feeor deduction of platform/processing charges may apply.
- Refunds (if applicable) will be processed to the original payment method or credited to the Customer’s Wallet within 7–10 working days.
- Partner Cancellations
- Partners may cancel an accepted booking only under genuine and unavoidable circumstances (e.g., medical emergency, technical issue, or force majeure).
- Customers will be informed immediately, and JustSeva may attempt to reassign the booking to another available Partner.
- Repeated cancellations by a Partner without valid reason may result in penalties, deduction of wallet credits, lower ratings, or account suspension.
- No-Show & Incomplete Service
- If a Customer is unavailable at the scheduled service time or refuses service without valid reason, the booking may be marked as Customer No-Show, and applicable charges may still apply.
- If a Partner accepts a booking but fails to attend or complete the service, the Customer may be entitled to a partial or full refund/credit, depending on the situation.
- JustSeva will review such cases and reserves the right to decide refund amounts on a case-by-case basis.
- Refund Processing
- Refunds will be initiated only after proper verification of the cancellation/incomplete service claim.
- Refund amounts may exclude platform fees, convenience charges, or any non-refundable components.
- The timeline for refunds depends on the payment provider but generally takes 7–10 business days.
- Platform Rights
- JustSeva reserves the right to deduct applicable charges/penalties before issuing any refund.
- Decisions made by JustSeva regarding cancellations, no-shows, and refunds shall be final and binding.
9. Roles & Responsibilities
9.1 Customer Responsibilities
Customers agree to:
- Provide accurate and complete details while booking services (location, time, special requirements, etc.).
- Ensure the premises are safe and accessible for Partners to perform the service.
- Treat Partners with respect and courtesy; avoid any form of abuse, harassment, or discrimination.
- Use the Platform only for legitimate bookings and not for fraudulent, false, or prank orders.
- Make timely payments for services as per the confirmed booking and agreed rates.
9.2 Partner Responsibilities
Partners agree to:
- Deliver services in a professional, lawful, and timely manner.
- Maintain all necessary licenses, permits, certifications, tools, and equipment required for their trade.
- Ensure that charges to Customers are transparent and only for the services agreed upon.
- Avoid any misrepresentation of qualifications, pricing, or service scope.
- Maintain high standards of safety, hygiene, and ethical behavior while providing services.
- Accept that repeated cancellations, poor conduct, or failure to deliver services may result in penalties or suspension.
9.3 JustSeva Responsibilities
JustSeva undertakes to:
- Act as a facilitator/aggregator, connecting Customers with verified Partners.
- Provide a secure platform for bookings, payments, and communication.
- Offer customer and partner support for queries, complaints, or technical issues.
- Maintain a fair and transparent dispute resolution mechanism in case of conflicts between Customers and Partners.
- Take reasonable steps to verify Partners but clarify that the ultimate responsibility for service quality lies with the Partner.
10. Prohibited Activities
When using the JustSeva Platform, Customers, Partners, or any Users shall not:
- Use the Platform for any unlawful, illegal, or fraudulent purposes, including money laundering, impersonation, or identity theft.
- Create multiple fake, duplicate, or misleading accounts to manipulate bookings, ratings, or promotional offers.
- Post, upload, or share any false, offensive, misleading, defamatory, obscene, or abusive content through the Platform.
- Attempt to hack, reverse-engineer, copy, extract, or misuse our Platform, software, databases, or payment systems.
- Circumvent the Platform by attempting to directly contact Customers/Partners outside JustSeva to avoid platform fees or commissions.
- Upload or transmit any malware, viruses, or harmful code that may disrupt or damage the Platform.
- Engage in behavior that is abusive, threatening, discriminatory, or harassing towards Customers, Partners, or JustSeva staff.
- Misuse Wallet balances, promo codes, or referral benefits in a way that constitutes fraud or unfair advantage.
- Violate any applicable laws, regulations, or licensing requirements while using or providing services through JustSeva.
⚠️ Consequences: Violation of these rules may lead to account suspension, legal action, penalties, and forfeiture of Wallet balances or pending payments.
11. Intellectual Property
- Ownership
All content and materials on the JustSeva Platform, including but not limited to logos, brand names, trademarks, service marks, designs, graphics, icons, text, images, audio, video, software, source code, databases, and overall platform layout, are the exclusive property of JustSeva or its licensors. These are protected under applicable intellectual property and copyright laws in India and internationally. - Limited User Rights
Users are granted a limited, non-transferable, non-exclusive, revocable license to access and use the Platform solely for personal or authorized business purposes. This license does not allow Users to:- Copy, reproduce, modify, distribute, display, or republish any content without written consent.
- Use JustSeva’s intellectual property for commercial purposes outside the Platform.
- Create derivative works, reverse-engineer, or exploit any portion of the Platform.
- Prohibited Use of Trademarks
The name “JustSeva”, its logos, slogans, and brand identifiers may not be used in any manner (including domain names, advertising, promotions, or publicity) without prior written authorization from JustSeva. - Third-Party Rights
Some logos, service listings, or content on the Platform may belong to third-party Partners or licensors. Such intellectual property remains the property of their respective owners, and Users must respect those rights. - Violation Consequences
Any unauthorized use of JustSeva’s intellectual property may result in:- Immediate termination of account access.
- Legal action for damages, injunctions, or penalties as permitted by law.
12. Disclaimers & Limitation of Liability
- Service Disclaimer
The services listed on JustSeva are provided by independent Partners/Service Providers, not by JustSeva directly. Therefore, all services made available through the Platform are provided strictly on an “as is” and “as available”basis. - No Warranties
To the maximum extent permitted by law, JustSeva makes no representations, guarantees, or warranties (express or implied) regarding:- The availability, suitability, or reliability of specific Partners or services.
- The quality, safety, legality, or outcome of services delivered by Partners.
- The Platform is error-free, uninterrupted, and free from technical glitches, viruses, or harmful components.
- Customer Acknowledgement
By using the Platform, Customers acknowledge and agree that:- All service-related risks remain with the Customer and Partner.
- JustSeva is only a facilitator and cannot be held responsible for damages, delays, injuries, losses, or dissatisfaction caused by a Partner.
- Limitation of Liability
- To the fullest extent permitted by law, JustSeva (including its affiliates, employees, directors, and agents) shall not be liable for any direct, indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or personal/property damages.
- In any case, JustSeva’s total liability shall not exceed the amount paid by the Customer for the specific booking that gave rise to the claim.
- Third-Party Services
The Platform may contain links or integrations to third-party tools, websites, or payment gateways. JustSeva is not responsible for the performance, accuracy, or security of such third-party services.
13. Dispute Resolution
- Customer–Partner Disputes
- Any dispute, disagreement, or claim arising from the service (including quality, timeliness, or behavior) is primarily between the Customer and the Partner.
- JustSeva acts only as a facilitator and does not assume responsibility for resolving such disputes.
- Role of JustSeva
- JustSeva may, at its discretion, assist in mediating disputes to promote fairness and goodwill between Customers and Partners.
- Such mediation will be limited to reviewing available records (booking details, communications, payment logs, etc.) and suggesting a resolution.
- However, the final responsibility for resolving the dispute lies with the Customer and Partner.
- Raising a Complaint
- Customers or Partners may raise complaints by writing to support@justseva.com within 48 hours of service completion (or the scheduled date, in case of a no-show).
- Complaints must include booking details, description of the issue, and any supporting evidence (photos, screenshots, receipts, etc.).
- Refund/Compensation Decisions
- In cases involving payment disputes, JustSeva reserves the right to withhold, adjust, or release funds from the Partner’s Wallet or settlement amount.
- All decisions by JustSeva regarding refunds, credits, or penalties shall be final and binding.
- Legal Remedies
- If parties are dissatisfied with the mediation outcome, they may pursue remedies available under applicable laws, subject to the jurisdiction outlined in these Terms.
14. Termination & Suspension
- Grounds for Termination/Suspension
JustSeva reserves the right to suspend, restrict, or permanently terminate any account (Customer or Partner) without prior notice if the user is found engaging in:- Breach or violation of these Terms & Conditions or any applicable policies.
- Fraudulent activity, including fake bookings, false claims, or payment fraud.
- Misuse of the Platform for illegal, abusive, or unethical purposes.
- Harassment, threats, or misconduct towards Customers, Partners, or JustSeva staff.
- Repeated cancellations, no-shows, or service failures that affect Platform reliability.
- Any action that may harm the reputation, operations, or intellectual property of JustSeva.
- Pending Payments
- On termination, any pending payments, Wallet balances, or settlements may be withheld until a full investigation is completed.
- If fraudulent or unlawful activity is confirmed, JustSeva reserves the right to forfeit such balances and recover damages, if applicable.
- Voluntary Termination by User
- Customers or Partners may request account closure by contacting support@justseva.com.
- Any pending transactions, refunds, or settlements must be cleared before account closure is finalized.
- Effect of Termination
- Access to the Platform and associated services will be revoked immediately.
- Certain obligations (such as payment of dues, confidentiality, and compliance with applicable laws) shall survive termination.
- Reinstatement
- Reinstatement of a suspended account is at the sole discretion of JustSeva, subject to satisfactory resolution of the issue.
15. Indemnity
By using the JustSeva Platform, you agree to indemnify, defend, and hold harmless JustSeva, its parent company, affiliates, directors, officers, employees, and agents from and against any and all claims, demands, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:
- Misuse of Services: Any improper, unlawful, fraudulent, or unauthorized use of the Platform or services.
- Violation of Terms: Any breach of these Terms & Conditions, policies, or applicable laws by you or under your account.
- Disputes Between Customer and Partner: Any conflict, claim, or dispute regarding the quality, timeliness, safety, or outcome of services between Customers and Partners.
- Content or Submissions: Any user-generated content (reviews, listings, photos, comments, etc.) uploaded by you that infringes on intellectual property rights, violates laws, or causes reputational harm.
- Third-Party Claims: Any claims made by third parties (including government authorities) due to your actions, omissions, or non-compliance while using the Platform.
⚠️ This indemnity obligation will survive the termination or suspension of your account and continue even after you stop using the Platform.
16. Governing Law & Jurisdiction
- Applicable Law
These Terms & Conditions, together with all policies and additional agreements on the Platform, shall be governed by and interpreted in accordance with the laws of India, regardless of your country of access or residence. - Dispute Escalation Process
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform, the parties agree to follow this escalation process:- Negotiation – The parties shall first attempt to resolve the matter amicably through good-faith discussions within 15 working days of the dispute being raised.
- Mediation – If not resolved, either party may request mediation facilitated by JustSeva or a mutually agreed third party within 30 working days.
- Arbitration – If mediation fails, the matter shall be referred to binding arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 (India). The arbitration shall be conducted by a sole arbitrator appointed by JustSeva, and the language of arbitration shall be English.
- Courts of Law – If arbitration is not applicable or enforceable, the matter shall fall under the exclusive jurisdiction of the competent courts in Lucknow, Uttar Pradesh, India.
- Seat & Venue of Arbitration
The seat and venue of arbitration shall be Lucknow, Uttar Pradesh, India. - International Users
If you access or use JustSeva from outside India, you are solely responsible for compliance with local laws. However, you agree that any dispute, claim, or proceeding shall still be governed by the laws of India, and you submit to the jurisdiction of courts in Lucknow, Uttar Pradesh. - Final & Binding Decision
The decision of the arbitrator or court (as applicable) shall be final and binding on all parties.
17. Amendments
- Right to Modify
JustSeva reserves the right to update, revise, or modify these Terms & Conditions, as well as any related policies (including Privacy, Refund, or Partner Terms), at any time to reflect changes in law, business practices, or service offerings. - Notification of Changes
- Significant changes will be communicated through the Platform via notices, pop-ups, emails, or app notifications.
- Minor or routine updates may be posted directly on the Platform without individual notice.
- Effective Date
Unless otherwise stated, revised Terms will become effective immediately upon publication on the Platform. - User Responsibility
It is the responsibility of Customers and Partners to review the Terms periodically. Continued access or use of the Platform after any modification shall be deemed as acceptance of the revised Terms. - Withdrawal of Consent
If you do not agree with the revised Terms, you must stop using the Platform immediately and may request account termination as per Clause 14 (Termination & Suspension).
